1. Agreement to Terms
These Terms and Conditions (“Terms”) govern the services provided by BrushCuts, LLC (“BrushCuts,” “Contractor,” “we,” “us,” or “our”), a forestry mulching and land clearing company operating in Virginia. By requesting a quote, accepting an estimate, scheduling services, or engaging BrushCuts in any capacity, you (“Customer”) agree to be bound by these Terms. These Terms are incorporated into and form part of any Service Agreement or QuickBooks Estimate accepted by the Customer.
2. Scope of Work
The specific scope of work, project location, and pricing for each job are detailed in the accompanying QuickBooks Estimate provided to the Customer. BrushCuts provides the following services in Virginia and surrounding areas:
- Forestry mulching and vegetation management
- Land clearing
- Lot clearing
- Trail cutting
All cleared vegetation and debris will be mulched and left on-site unless otherwise specified in the Estimate. Hauling, removal, or off-site disposal is not included unless explicitly stated.
3. Payment Terms
No deposit is required unless otherwise stated in the Estimate. Full payment is due within 30 days of the invoice date following completion of work. Accepted payment methods include check, bank transfer, and credit card.
Late payments may incur a finance charge of 1.5% per month (18% annually) or the maximum rate allowed by applicable law.
4. Performance and Scheduling
BrushCuts will perform all work in a professional manner using appropriate equipment. Project start and completion dates are estimates only and may be affected by weather conditions, site conditions, equipment availability, or other unforeseen circumstances.
The Customer agrees to:
- Provide safe and unobstructed access to the work area
- Ensure property boundaries are clearly defined
- Obtain any necessary permits, permissions, or approvals for the work
5. Changes and Additional Work
Any changes to the scope of work or additional services requested by the Customer must be approved in writing (including via email or updated estimate) prior to commencement of the additional work. Changes may result in additional charges.
6. Liability, Site Risk, and Insurance
BrushCuts, LLC maintains general liability insurance. Proof of insurance is available upon request.
The Customer acknowledges and agrees that:
- Forestry mulching involves heavy equipment and may result in ground disturbance, ruts, or incidental surface damage
- BrushCuts is not responsible for damage to underground utilities, irrigation systems, septic systems, or other hidden or unmarked hazards
- The Customer is responsible for identifying and clearly marking all underground utilities and known hazards prior to commencement of work
- BrushCuts is not responsible for pre-existing site conditions or damage resulting from following Customer-provided instructions
7. Weather Delays
Work may be delayed, rescheduled, or paused due to unsafe or unsuitable weather conditions at BrushCuts’ discretion. BrushCuts will notify the Customer as soon as practicable in the event of a weather-related delay.
8. Cancellation
If a project is canceled after work has begun, the Customer agrees to pay for all labor, time, and materials incurred up to the point of cancellation.
9. Limited Warranty
BrushCuts warrants its workmanship for a period of 30 days from the date of project completion. This warranty does not cover:
- Damage caused by weather, erosion, or natural conditions
- Damage caused by animals, third parties, or Customer actions
- Changes in site conditions after completion of work
10. SMS Messaging Terms

These messages may include appointment confirmations, project updates, estimates, and other communications related to your service.
Message frequency varies based on customer interactions. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Reply HELP for assistance. Consent to receive SMS messages is not a condition of purchase.

11. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia. Any disputes arising from or related to services provided by BrushCuts, LLC shall be subject to the jurisdiction of the courts of Virginia.
12. Entire Agreement
These Terms, together with the accepted QuickBooks Estimate and any accompanying Service Agreement, constitute the entire agreement between the parties and supersede all prior discussions, representations, or understandings.
13. Acceptance
By accepting a QuickBooks Estimate or engaging BrushCuts for services, the Customer acknowledges that they have read, understood, and agree to all terms and conditions set forth herein.
